§1 Scope

These Terms and Conditions apply to all orders placed by consumers through the MyComfyNest online store.

§2 Conclusion of Contract

The presentation of products in the online store does not constitute a legally binding offer, but rather an invitation to place an order.

By clicking the button “Buy Now” or “Order with Obligation to Pay”, you submit a binding order.

The purchase contract is concluded only when we confirm the order or dispatch the goods.

§3 Prices and Shipping Costs

All prices shown include applicable VAT.

Any additional shipping costs will be clearly displayed during the checkout process.

§4 Payment

Payment can be made using the payment methods offered during checkout.

We reserve the right to exclude certain payment methods in individual cases.

§5 Delivery

Delivery is made to the shipping address provided by the customer.

Estimated delivery times are indicated on the respective product pages.

If a product is unavailable, we will inform the customer without undue delay.

§6 Retention of Title

The goods remain our property until full payment has been received.

§7 Right of Withdrawal

Consumers are entitled to the statutory right of withdrawal.

§8 Personalized Products

Personalized or custom-made products are excluded from the right of withdrawal where legally permitted.

This applies in particular to products with custom embroidery, names, birth dates, individual print designs, or other customer-specific modifications.

Statutory warranty rights remain unaffected.

§9 Warranty

The statutory warranty rights under German law shall apply.

§10 Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR):

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

§11 Applicable Law

The laws of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG), unless mandatory consumer protection provisions provide otherwise.
